Compliance Index

The ONDEC compliance Index is a public accountability log documenting unresolved procedural compliance failures. Entries are based on verifiable artifacts and are maintained with a visible change log and a right of reply.

The Index records process status only. Inclusion does not constitute a finding of misconduct, intent, or wrongdoing.

Purpose of the Compliance Index

The Compliance Index exists to document whether clearly defined procedural, statutory, or administrative obligations are met within required timelines.

It is a factual record of compliance status - not an evaluation of ethics legality, or motive.

 

Inclusion Criteria

An entry may be added to the Compliance Index only when all of the following conditions are met.

 

1. A Lawful Obligation Exists

The matter involves a documented legal or procedural duty, including but not limited to:

  • Open Records Act requests
  • Statutory response obligations
  • Formal ethics, governance, or compliance inquiries
  • Record-preservation notices

2. The Obligation Is Documented

The initiating action is preserved in writing and includes:

  • Date Submitted
  • Method of submission
  • Scope of request or obligation
  • Identifiable recipient or responsible office

3. Applicable Timelines Have Elapsed

The applicable response period has:

  • Expired without response, or
  • Resulted in a partial, incomplete or non-responsive reply, or
  • Produced a refusal without sufficient procedural explanation

4. The Entry Is Factual and Non-Editorial

Each Compliance Index Entry records:

  • The entity or office involved
  • The responsible role or office, if applicable
  • The type of request or obligation
  • The current status (Pending, Overdue, Partial Response No Response, Closed)

5. Scope Limitations

The Compliance Index does not include:

  • Private individuals
  • Minors
  • Judges acting in a judicial capacity
  • Allegations unrelated to procedural compliance

The Index is not a forum for advocacy, litigation, or accusation.

6. Updates and Corrections

Entries are update when:

  • Compliance is achieved
  • A response is received
  • Clarifying documentation is provided

Verified corrections are appended promptly with a visible timestamp.

Access
